1. Definitions

“Report” means a vehicle history report or other vehicle information output generated by our systems and made available to you (paid or free).

“Services” means our website, report generation, delivery tools, user account functions (if offered), and any related content we provide.

“You” means the user of our Services, including a purchaser of a Report.

2. Eligibility and Use

You must be at least 18 years old (or have the consent of a parent/guardian) to purchase a Report.

You agree to use our Services only for lawful purposes and in accordance with these Terms. We may restrict, suspend, or terminate access where we reasonably believe your use breaches these Terms or applicable laws.

3. Scope of Services

AUCN provides:

• Vehicle history and risk information through Reports (including, where available, registry-based results and other data); and
• Educational content about vehicle checks and used-car purchasing risks.

AUCN does not:

• physically inspect any vehicle;
• verify a seller’s identity or representations;
• provide mechanical, legal, financial, or safety advice; or
• guarantee that a vehicle is safe, roadworthy, defect-free, or fit for any purpose.

You should obtain independent professional advice (e.g., mechanical inspection) before buying any vehicle.

4. Data Sources and Report Limitations

Reports may include information from official registers and third-party data sources, which may include (where available) the Personal Property Securities Register (PPSR), manufacturer recall information, registration-related datasets, and other licensed or publicly available sources.

You acknowledge and agree that:

• Reports are generated based on information available to us at the time of the search and may change after a Report is issued;
• some records may be delayed, incomplete, unavailable, corrected later, or not provided to any third party at all;
• we do not control third-party or official data sources and cannot guarantee they are current, complete, error-free, or available at all times; and
• Reports are provided for information purposes only and are provided on an "as is" and "as available" basis.

5. Your Responsibilities

You are responsible for:

• entering correct vehicle identifiers (such as VIN and/or registration number) and selecting the correct state/territory where required;
• confirming that the vehicle details match the vehicle you intend to check; and
• using the Report appropriately as one input into your buying decision.

To the extent permitted by law, AUCN is not responsible for issues caused by incorrect inputs or selecting the wrong vehicle.

6. Accounts and Access (if applicable)

You may be able to create an account to manage purchases and access Reports. Guest checkout may also be available.

You agree to:

• keep your login details secure;
• not share or transfer your account; and
• notify us promptly if you suspect unauthorised access.

We may disable accounts that appear to be compromised or used in breach of these Terms.

7. Intellectual Property and Permitted Use of Reports

All content on our website, and all Reports (including formatting, presentation, and compilation), are owned by AUCN or our licensors and are protected by intellectual property laws.

Unless we expressly agree otherwise in writing:

• Reports are provided for personal use and internal reference only.
• You must not resell, sublicense, redistribute, publish, scrape, extract, or systematically collect data from Reports or our website.
• You must not use any automated means (bots, scrapers, crawlers) to access the Services or harvest data, except where permitted by law or with our written permission.

8. Pricing, Payment, Delivery

Prices are displayed before purchase and are inclusive of GST where applicable (unless stated otherwise).

Reports are delivered electronically once payment is successfully processed. Delivery times may vary based on system availability and third-party source responsiveness.

You are responsible for ensuring you can receive electronic delivery (e.g., correct email address, network access).

9. Refunds and Consumer Rights

Because Reports are digital products generated based on a specific search, we do not generally offer refunds once a Report has been delivered, including where you have entered incorrect details.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantees or rights you may have under the Australian Consumer Law (ACL) or any other applicable law. Where a consumer guarantee applies and is not capable of being excluded, our liability is limited to the remedies available under the ACL.

If you believe there is an issue with your purchase (for example, technical delivery failure), please contact us and we will assess the issue in good faith.

10. Third-Party Links, Referrals and Commissions

Our website may contain links to third-party websites or services. We may also refer you to third-party products or services and may receive a commission or referral fee if you engage with them.

• Third-party services are not operated by AUCN.
• We do not control or endorse third-party content, availability, pricing, or performance.
• Your dealings with third parties are solely between you and the third party.

11. Website Rules and Prohibited Conduct

You must not:

• misuse the Services, attempt to interfere with security, or bypass access controls;
• impersonate others or provide false or misleading information;
• upload or transmit malicious code;
• use the Services to infringe intellectual property, privacy, or other rights; or
• use the Services in a way that violates laws or regulations.

12. Disclaimer and Limitation of Liability

To the maximum extent permitted by law:

• We exclude all warranties not expressly set out in these Terms.
• We are not liable for any loss arising from reliance on a Report, including where records are incomplete, delayed, inaccurate, or unavailable due to third-party sources.
• We are not liable for any dispute between you and a vehicle seller, buyer, dealer, or any other third party.

Where liability cannot be excluded, our liability is limited to the extent permitted by law and, where applicable, to the remedies required under the ACL.

13. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless AUCN (and our directors, officers, employees, and contractors) against claims, losses, liabilities, costs, and expenses arising from:

• your misuse of the Services;
• your breach of these Terms; or
• your infringement of any rights of another person.

14. Changes to These Terms

We may update these Terms from time to time. The updated Terms will be published on our website with a revised effective date. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales.
